ARCS Marketing Services: Terms & Conditions

These terms and conditions ("terms") are a legal, binding agreement between Abuse-Recovery Counseling, LLC, a Wyoming limited liability company and any of its subsidiaries, affiliates, or other entities controlled directly or indirectly (the “ARCS”) and you, an independently operating Certified Addiction-Recovery Coach and/or Certified Abuse-Recovery Coach (“CARC”), whether acting in an individual capacity or through a business entity. Acceptance of these terms is a condition to your purchase of leads and marketing services from ARCS. You accept these terms by purchasing leads or marketing services from ARCS. You agree that each request for delivery of leads or request for marketing services is subject to these terms and the terms of the Independent Contractor Agreement signed by and between you and ARCS.
If you do not agree to any or all of these terms you may not purchase leads or obtain marketing services from ARCS.
You agree to purchase from ARCS data collected from prospective Student-Clients who submitted contact information through an online or print advertisement paid for by ARCS (“leads”) and/or allow ARCS to place advertisements on your behalf. ARCS makes no representations about the quantity, sufficiency, or quality of leads that it provides to you or the efficacy of any advertisement ARCS places on your behalf. You will be charged a cost per lead, per bundle of leads, or per advertisement placed, stated at the time of the purchase, and the cost may vary from purchase to purchase. Fees accrue and are due upon your receipt of the leads or placement of advertisements. You agree to provide ARCS with current and valid credit card information (type, name, number, expiration date, etc.) or other acceptable payment information and hereby authorize us (directly or through our agents) to charge the payment method you have provided in the amount of all or part of the fees payable for the leads purchased or advertisements placed plus any taxes we may be required to collect. Purchases of leads or placement of advertisements are not cancellable, and fees paid are not refundable. You are not authorized to use any leads that are not paid for.

Independently Placed Ads

ARCS is very happy to provide you (Coach, Teacher) and Student-Clients with access to Company materials and websites through our online student and client portals. We have devoted a great deal of time, energy, and money to the creation of our programs and it is critically important that all Coaches are presenting ARCS in the best possible light and with information that is as accurate as possible.
As you know, a Coach may not use the Company’s logos, taglines, links, and other proprietary content on the Coach’s website, business cards, literature, and in other forms without prior approval. Additionally, a Coach also may not discuss the Company’s confidential information or programs in any manner designed for or resulting in a Student-Client enrolling in an ARCS Program unless the content of the Coach’s discussion with the prospective student-client is approved in advance.
If you are publishing any form of advertising or engaging in any discussion designed to either directly or indirectly enroll Student-Clients in an ARCS Program, ARCS must approve all such marketing content, processes and plans. Unfortunately, if a Coach has not obtained pre-approval of any of the above, the Coach is in breach of our independent contractor agreement.
Obtaining approval is fast and easy and we approve 90% of the requests from our Coaches on the first request. Please use ARCS Ad Authorization Form to submit the content of any advertisements you are placing along with the text of the script, bullet points, or outline you are using when speaking with prospective Student-Clients so that we can approve the text quickly and ensure that you receive all compensation due under our agreement.
Any coach engaging in independent advertising, marketing or other promotion designed to enroll individuals into their respective ARCS Class must complete an Ad Authorization Form. Failing to submit this material could result in the termination of your Teaching Agreement with ARCS.
